Epixtar and FTC Reach Agreement

MIAMI - (BUSINESS WIRE) - July 6, 2004 - Epixtar Corporation (OTCBB:EPXR - News) today announced that it had reached a stipulated final judgment and order for permanent injunction with the Federal Trade Commission. The FTC had previously sued Epixtar for allegedly engaging in unfair and deceptive acts and practices in connection with the sale of its Internet (ISP) services. The mutually agreed upon Order is remedial in nature and "does not constitute and shall not be interpreted to constitute an admission by Epixtar or its ISP subsidiaries, or a finding that Epixtar or its ISP subsidiaries have engaged in violations of any law or regulations, including the Federal Trade Commission Act".

The agreement was reached between counsel for Epixtar and the Regional Director of the FTC's northeast region where the original case was filed and executed by the chief executive of the Company on June 23, 2004. As is customary in matters of this type, the order will be submitted to the district court Judge for her approval upon the anticipated execution by the full Commission.
